Whereas the Board of Directors (“Board”) of the Marquez Knolls Property Owners Association (“MKPOA”) is in possession of a List of names, addresses and contact information of owners, lessors, lessees and renters in the Marquez Knolls area of Pacific Palisades, and members of the MKPOA;

Whereas the Board considers the List and the information the List as being personal and private and not to be disseminated to persons or entities other than Board members;

Whereas the Board intends to provide certain Board members with access to the List from time to time;

Whereas the Board is desirous of preventing the dissemination of, and access to, the List and the information in the List, by persons and entities other than members of the Board and persons specifically authorized to have access to the List to the extent reasonably possible;

IT IS HEREBY STIPULATED, UNDERSTOOD AND AGREED by each and every Board member that, until such time as the Board decides otherwise, the following shall constitute and express the Privacy Policy of the Board in relation to the List and the information in the List:

1. The List and the information in the List shall be held in strict confidence and treated as personal and private information.
2. The List and the information in the List shall be exclusively kept and maintained in the possession of the Executive Committee of the Board and by individuals specifically appointed as Membership Data Custodians.
3. Membership Data Custodians shall be appointed by a majority vote of the Executive Committee [or full Board of Directors]. The current Membership Data Custodians are Marie McKenna, Haldis Toppel, Mark Galanty, and Elissa Ashwood. Appointees may be updated as needed by the Executive Committee [or Board].
4. All persons who are provided with access to the Membership List must agree to handle, use and secure membership data in accordance with MKPOA’s established Privacy Policy. Unauthorized use, disclosure or distribution of membership data is strictly prohibited.
5. The List and the information in the List shall only be accessed and used by the Executive Committee for the purpose of furthering and/or achieving the goals and purposes of the board and/or the MKPOA, except when necessitated by serious emergent circumstances that clearly override the interests of privacy protection.
6. The Executive Committee may transmit the List and any and/or all of the information in the List to persons other than Executive Committee members only for the purpose of furthering and/or achieving the goals and purposes of the Board and/or the MKPOA and, in the event that the List is transmitted to any other such other persons, the Executive Committee shall inform each such person of this Privacy Policy and require each such person to agree to abide by such Privacy Policy, except when necessitated by serious emergent circumstances that clearly override the interests of privacy protection.
7. The List shall be protected from hacking and/or accidental distribution as much as is reasonably possible.
8. There shall be a periodic review of the manner in which the List and the information in the List is being protected from unauthorized use and/or disclosure.

The Executive Committee [or Board] reserves the right to revise this policy as needed to facilitate the privacy and security of member information.
